A patient's expectations must be set at the very beginning of the plastic surgery process. Many people have expectations beyond what is possible. They need to know that if the procedure isn't just a "touch-up," they may not be satisfied, but it also may not be negligence. However, if a doctor shows you a picture and tells you that is what you will look like after the surgery and you do not, that may be considered a breach of contract and may be actionable under the law.

There are many types of procedures that often result in complications, injuries and infections. Below are just some of the plastic surgery malpractice cases that we confidently handle.

Breast Implant Malpractice: Pictures need to be taken before and after breast augmentation to document any irregularities that may occur, such as tremendous and unnecessary scarring caused by malpractice. Doctors also should plan the procedure ahead of time. If they do not, this should raise a red flag for patients. Some of the common problems that arise include:

  • Uneven breast size
  • Uneven nipple level
  • Oversized implant (or overfilling of a saline implant)
  • Improper positioning of the implant (which can cause the suture line to open, leading to bleeding and necrosis)

Eyelid Surgery: If too much fat or skin is taken out of the upper or lower lid, a patient may not be able to close his or her eyelid properly. This can result in injury to the muscles or damage to the tear ducts, causing dry eye or constant eye drainage, requiring medical attention.

Tummy Tuck: If bleeding occurs after a tummy tuck and is not addressed in a timely manner, the patient could suffer a severe loss of tissue. Doctors need to be monitoring patients for this situation.

Face Lift: A full face lift is not a benign procedure. The doctor's experience counts for a lot. If there is an abundance of scarring, negligence may have occurred as the scars should be thoroughly hidden in the hairline and absent from view. Also, if a nerve is nicked or cut, the negligence can result in facial nerve palsy or Bell's palsy which causes a devastating condition in which the patient may experience uncontrolled drooling, drooping of part of the face, and speech problems.
