Basic Workers' Compensation Eligibility Requirements

In order to receive workers' compensation benefits you must be eligible for workers' comp. There are three basic eligibility requirements for workers' compensation. They include:

  • First: Your employer is legally required to carry workers' compensation insurance and does carry it.
  • Second: You are an employee of the individual or company employer
  • Third: The injury or illness is work-related

Does Your Employer Carry Workers' Compensation Insurance?

State laws regulate whether an individual or company employer must carry workers' compensation insurance. Factors such as how many people are employed and whether the employer is a charity determine this. If your employer is required by state law to carry workers' compensation insurance, then this particular eligibility requirement is met. In some instances an employer may even opt to carry it.

Are You an Employee of the Individual or Company Employer?

While this may seem like an obvious question, there are situations, particularly with contractors and subcontractors, where it is not a black-and-white answer. Furthermore, independent contractors, such as freelance writers, are not employees. In addition, if you are a volunteer, you are not considered an employee. You must receive compensation for your work in order to qualify as an employee.

Was the Injury or Illness Work-Related?

The injury or illness must have occurred at work or was related to work. In general, any conduct done for the benefit of the employer is considered work-related. There are injuries that are closely-related to work but require further scrutiny. This can be examined by your attorney.
