What to ask before hiring a medical malpractice attorney

A hospitalization usually means that you will undergo a procedure or will be monitored to see if certain medications are working. Being injured or sickened is not your expectation. Unfortunately, thousands of people across the U.S. are harmed through negligent actions. In these instances, the law allows for negligent physicians and hospitals to be held accountable through medical malpractice lawsuits.

But most people have no experience in hiring an attorney; relying instead on referrals from family and friends. If you are choosing an attorney, a short interview is helpful. This post will highlight a few important ones that can help in determining which firm is right for you. 

How did you start handling malpractice cases? –When asking about how the attorney started handling malpractice cases, he or she should be able to tell you a compelling story about their background and experience. The attorney should convince you that he or she is experienced and capable. After all, they will ultimately have to persuade a jury

How many malpractice cases do you handle at a time? – The attorney should also be able to describe how much of their caseload is devoted to medical malpractice cases. This is also important in measuring their capability against someone who primarily handles auto accident or workers’ compensation cases, as an example.

What are some of the strengths and weaknesses of my case? – Indeed, clients want to know how “good” their case is. Since a great deal of money may be spent on developing the case, a knowledgeable attorney will describe the risks and drawbacks that may ultimately arise, and explain how the process will work.
