A severely disabled 10-year-old girl recently won $3 million in a medical malpractice case against a midwife. The jury decided that the midwife breached the standard of care while conducting the girl's delivery and that this breach caused the girl's disabilities. The girl was awarded $500,000 for her permanent impairment and loss of enjoyment of life. The girl was also rewarded $2.3 million for future medical bills and $345,000 for past medical expenses.
The birth injury was likely caused by a lack of oxygen, or hypoxia, and caused the daughter to suffer severe retardation among other things. The girl is completely dependent and she is blind, deaf, and unable to talk. She is wheelchair bound and is fed through a tube. The girl also has Kabuki Syndrome.
Parents of another child also sued the midwife in 2007 for failing to recommend an emergency Cesarean section after indications that a baby was in fetal distress. That child was born with cerebral palsy from a lack of oxygen during birth.
