Lawsuit alleges patient’s death was the result of diagnosis-related negligence

| Aug 20, 2012 | Failure To Diagnose & Misdiagnosis

It is very important for medical professionals to not commit diagnosis-related negligence when caring for patients. Such negligence can cause a great deal of harm to patients. Sadly, such negligence can sometimes even result in a patient’s death.

Recently, a wrongful death case has arisen involving allegations of diagnosis-related negligence. The case is from West Virginia. The case involves a man who reportedly received care from a doctor in October 2010.

The man’s family alleges that the doctor failed to diagnose a condition the man suffered from in a timely manner and failed to treat this condition in a timely manner. The condition in question was appendicitis.

According to the man’s family, the alleged negligent delays in the diagnosis and treatment of the man’s condition caused the man to suffer a variety of harms and led to the man’s death. The man’s death reportedly occurred on Oct. 28, 2010.

The man’s family has brought a wrongful death lawsuit in a court in West Virginia against the doctor in connection to the above allegations. Reportedly, this lawsuit is asking for punitive and compensatory damages. It will be interesting to see what ultimately happens in this case.

As the allegations in this wrongful death case underscore, diagnosis-related negligence can be extremely harmful. Thus, one hopes that all medical professionals make sure to avoid committing negligence like that alleged in this case. No patient should have to suffer injuries or lose his or her life because a medical professional negligently failed to diagnose him or her in a timely manner.
