What Kinds Of Benefits Are You Entitled To Receive?

Every work-related injury is different, which is why there is more than one type of workers’ compensation benefit in Massachusetts. Depending on the nature and extent of your condition, you may be entitled to:

  • Temporary total disability: The majority of workers’ comp claims fall into this camp. These benefits compensate for when your injury prevents you from working for a limited time. They can help cover your expenses until you return to work.
  • Temporary partial disability: If your injury does not keep you from performing some work, but you still require treatment, temporary partial disability can help. These benefits are similar to temporary total disability, except that the scope of your injuries does not prevent you from performing any work.
  • Permanent partial disability: If you are permanently injured, but your injury only partly limits your ability to work, you may qualify for this type of benefit.
  • Permanent total disability: For situations where your injury has completely incapacitated you, keeping you from ever working again, permanent total disability is available.
  • Medical benefits: If your injury or illness is work-related, you’re entitled to medical coverage.

What About Rehabilitation?

Workers’ compensation also covers rehabilitation costs such as:

  • Physical therapy and related expenses for therapeutic medical equipment
  • Vocational rehabilitation — such as job retraining and tuition — if your injury prevents you from working in your previous field

Can I Get A Single Lump-Sum Payment?

Instead of receiving ongoing benefits, you may wish to pursue a lump-sum payout. These payouts have advantages and disadvantages. In some situations, you may end up getting far less than you deserve. You should never accept a lump-sum settlement without first consulting an attorney.
